IMPLEMENTATION OF THE CONVENTION ON THE RIGHTS OF THE CHILD


List of issues to be taken up in connection with the
consideration of the initial report of
Slovenia

General measures of implementation
(Arts. 4, 42 and 44, para. 6 of the Convention)


Is Slovenia considering the possibility of reviewing its legislation with a view to withdrawing its reservation to Article 9 paragraph 1 of the Convention?

What is the status of the Convention in relation to national law? Can and have the provisions of the Convention been invoked in court?

Please describe the policy in place in relation to the implementation of article 4 of the Convention with respect to the allocation "to the maximum extent of (...) available resources for the rights of the child". How has this principle been applied in budget discussions in recent times? What guarantees exist that local authorities are also guided by this principle in their policy making? How are children with special needs and children from the most vulnerable groups of society protected against any adverse effect of economic change, especially during the period of economic transition?

To what extent have school curricula been adjusted to give room for education about the Convention and human rights in general?

What activities have been undertaken or are being planned to orient or train professional groups to develop their knowledge, skills and attitudes on the rights of the child, as well as to handle matters relating to the psychological treatment and social reintegration of the children whose rights have been violated?


General principles
(Arts. 2, 3, 6 and 12)

What concrete measures have been taken to sensitize public opinion and educate personnel working with children about the need to encourage children's participatory rights?

Please indicate the ways in which the principle of respect for the views of the child is reflected in all matters affecting the child, particularly in judicial and administrative proceedings.



Civil rights and freedoms
[Arts. 7, 8, 13-17 and 37 (a) of the Convention]

Information contained in paragraph 38 of the report indicates that the naturalization of children can only take place in a few exceptional cases. Please provide more detailed information about those exceptions and the criteria which need to be met for a child to become naturalized.

Do special radio and television programmes for children exist in the Italian and Hungarian languages?

Please provide more information on the implementation of article 14 of the Convention, especially with regard to the determination of the choice of religious education of children. Is it the family which makes such decisions? How and to what extent does the child influence this decision?

What specific legal provisions exist to protect children from being ill-treated? Are there complaints procedures which can be used by children themselves against such violations?


Family environment and alternative care
(Arts. 5, 18 paras. 1 and 2, 9, 10, 27 para. 4, 20, 21, 11, 19, 39 and 25 of the Convention)

How many reported cases are there of child abuse within the family? What legislative measures have been adopted to protect the child against such abuse and maltreatment as laid down in art. 19 of the Convention? Is research undertaken into the problem of the ill-treatment and sexual abuse of children, including into the social factors which influence such violations? What measures have been taken to improve, as mentioned in para. 87 of the report, the lack of coordination between the services handling cases of child abuse? What procedures exist for intervention by the authorities in cases where a child needs protection from serious abuse within the family?

Please describe the procedures for national and inter-country adoption, including monitoring and supervision. What measures are taken to ensure that parents giving up their children for adoption are allowed sufficient opportunity to weigh the consequences and alternatives? At what age can a child him/herself influence a decision on adoption?


Basic health and welfare
(Arts. 6 para. 2, 23, 24, 26 and 18 para. 3., 27 paras. 1-3 of the Convention)

What proportion of the budget is allocated to health care and more specifically to child health care? Please comment on the balance between curative and preventive health programmes.

Please indicate to what extent the provisions of the Convention relating to the right to an adequate standard of living are being applied and provide specific information on the main measures adopted for this purpose.

Have any studies been undertaken to prevent any increase in the incidence of suicides?


Education, leisure and cultural activities
(Arts. 28, 29 and 31 of the Convention)

What portion of the national budget is reserved for education and which portion of it is allocated to primary compulsory education? What are the major items of expenditure in the education budget?

Have the draft laws mentioned in para. 133 of the report been adopted?


Special protection measures
(Arts. 22, 30 and 32-40 of the Convention)

To what extent is the Government's policy towards refugee and displaced children consistent with the principles of non-discrimination, the best interests of the child, the right to life, survival and development, and respect for the views of the child ?

What concrete measures have been taken for the implementation of article 39 of the Convention, especially with regard to children affected physically and psychologically by armed conflict, especially refugee children.

Please provide more detailed information on the national legislation prescribing the maximum length of pre-trial detention of children and its implementation in practice.

Please provide further information on the treatment of young law offenders and, in particular, on the following questions:

- What types of institutions exist for the custody of young law offenders and what specific official rules are there for their treatment?

- What opportunities are there for contact with relatives?

- How are the conditions in such institutions monitored?

- Are there complaints procedures in cases of ill-treatment?

- What measures are taken for the physical and psychological recovery and social reintegration of children in conflict with the law (art. 39)? and

- Have personnel in the institutions received training about provisions of the Convention and about international rules concerning the treatment of young offenders?

Has any recent study been undertaken on the existence of child labour in the country, especially in agriculture, and if not, does the Government plan to undertake such research in the future? Is statistical data available on the incidence of child labour in Slovenia?

According to paragraph 158 of the report, 40 percent of registered sexual assaults against children over the past ten years were discovered accidentally. What additional steps do the authorities envisage taking to prevent such abuse?

How serious is the problem of drug abuse among children in Slovenia?
